1. Learned counsel for the petitioner submit that while disposing the writ petition i.e. C.W.J.C. No. 1717 of 2017 on 17.05.2024 this court has permitted the petitioner to file appeal before the District Teachers Employment Appellate Authority (for short "District Appellate Authority") within one month alongwith condonation of delay petition with further direction to the District Appellate Authority to consider the same in accordance with law.

2. The modification application has been filed for extension of time granted for filing appeal within one month.

3. Learned counsel for the petitioner submits that due to some unavoidable circumstances the petitioner filed appeal on 19.07.2024 after a little delay. Accordingly, prayer is to extend the time of one month granted by this court till the date appeal has been filed by the petitioner.

4. Considering the aforesaid submissions, one month time granted by this court for filing appeal vide order dated 17.05.2024 passed in C.W.J.C. No. 1717 of 2017 is extended till the date appeal has been filed by the petitioner before the District Appellate Authority.

5. If the petitioner files condonation of delay petition before District Appellate Authority within four weeks from today, the appeal as well as condonation of delay petition shall be considered by the District Appellate Authority in accordance with law.

6. With the aforesaid observation and direction, this modification application is allowed.
