JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2019 This is an application for grant of anticipatory bail in connection with Excise Case No.700 of 2018, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 132.34 liters of country made liquor was recovered from the shop of the petitioner and he is an accused in one another case.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. Nothing has been recovered from the shop of the petitioner and he is on bail in another case.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation and

No.21560 of 2019(2) dt.09-05-2019 2/2 the quantity of the liquor recovered from the shop of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail on the basis of materials available on record.
