JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2018 The petitioner seeks bail in connection with Banka Mahila P.S.Case No. 04 of 2018 registered under Sections 341, 354A, 448, 504 and 506/34 of the Indian penal Code and 8 of the Protection of Children from Sexual Offences Act. Allegation against the petitioner is of outraging the modesty of the informant.

Submission of learned counsel for the petitioner is that petitioner has been falsely implicated in this case with respect to money dispute between the parties and he is in custody for more than three and half months having no criminal antecedent. Heard learned APP also who has opposed the prayer of bail stating that petitioner might have some criminal antecedent. Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of

Patna High Court Cr.Misc. No.73983 of 2018(2) dt.17-12-2018 2/2 with direction to the court below to verify the criminal antecedent of the petitioner and if it si found that petitioner has no criminal antecedent, court below shall release the petitioner on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Banka Mahila P.S. Case No. 04 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
