The petitioner is apprehending arrest in a case registered for the offences punishable under Section 364A of the Indian Penal Code.
The prosecution case is that informant's father being Branch Manager, Canara Bank, Rajla-Oraiya, Jhajha while returning home from the bank along with other employees they were kidnapped by the accused persons, leading to registration of FIR against unknown. The name of the petitioner, subsequently, sprang up on the confession of two co-accused. It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.45043 of 2015 (2) dt.16-10-2015 2/2 that victim has not named the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, co-accused Monu Burnwal, who named the petitioner, has been granted regular bail vide Criminal Miscellaneous No.17516 of 2015 and other co-accused Mustkim has been granted bail by the learned court below. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, keeping in view of the fact that other co-accused have been granted regular bail, if the petitioner surrenders within a period of six weeks in connection with Jhajha P.S. Case No.18 of 2015, pending before the learned SDJM, Jamui. With the above observation, this application is, accordingly, disposed off.
