The petitioner apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 53 of 2017 registered under Sections 323, 324, 341, 504, 307, 448, 427, 380 and 34 of the I.P.C. pending in the Court of C.J.M., Saran at Chapra. Submission of learned counsel for the petitioner is that petitioner and informant are next door neighbour living in the same village. Further submission is that there is general and omnibus allegation against the petitioner.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation of assault with intention to kill the informant
Patna High Court Cr.Misc. No.23449 of 2017 (3) dt.01-08-2017 2/2 against the petitioner and others.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
