The petitioner apprehends her arrest in Risiup P.S. case No. 40 of 2018 registered under Section 30(a)/ 38 of Bihar Prohibition & Excise Act.
The police apprehended a motorcyclist, who disclosed his name as Raj Kumar Gupta, and from whose possession 200 pouches of country made liquor, each containing 200 ml, were recovered. The petitioner is made accused in this case only on the ground that she is owner of the motor cycle. The learned counsel for the petitioner submits that petitioner is a lady. Raj Kumar Gupta had taken motor cycle for some work. The petitioner had no knowledge about the fact that Raj Kumar Gupta borrowed the motor cycle for carrying illicit liquor.

No.23521 of 2019(2) dt.11-04-2019 2/2 Taking into consideration the facts aforesaid and the fact that petitioner is a lady the petitioner, the petitioner, above named, in the event of her arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge, Excise Act, Aurangabad in connection with Risiup P.S. case No. 40 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
