The petitioner seeks bail in Banka Police Station Case No. 89 of 2020 registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code as well as under section 27 of the Arms Act. Prosecution's case, in brief, is that on 12.2.2019 at 4.30 pm the informant and his brother were going to Sasural on motorcycle. In the meantime, the petitioner, co-accused Shivjee Mandal and other accused persons, came on motorcycles and surrounded them. Thereafter, petitioner opened fire causing fire arms injury on the forehead of the informant. Co-accused Shivjee Mandal also opened fire causing injury on the arms of the informant.

Patna High Court CR. MISC. No. 23248 of 2020(3) dt.02-11-2020 2/2 Learned counsel for the petitioner submits that the petitioner is innocent. Co-accused has already been allowed bail by the court below itself. Petitioner has got no criminal antecedent and he is in custody since 2.3.2020. In view of the allegation of firing against the petitioner as well as the fact that one of the injuries sustained by the informant was fractured injury, prayer for bail of the petitioner is rejected.
