2. In this present case, the petitioner seeks bail in connection with Simultalla P.S. Case No. 05 of 2010 registered for the offences under Sections 323, 307, 379 and 498A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

3. As per prosecution case, petitioner is the husband of the complainant/informant and there are allegation of demand of dowry and consequent torture upon the informant. The petitioner and other co-accused persons finally drove out the informant from their house.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner has never demanded any dowry and never tortured the informant on this account. Coaccused parents-in-law of the informant have already been granted anticipatory bail by the learned subordinate court. The informant has solemnized second marriage with one Dinesh Ram and she has deserted the petitioner. Petitioner is in custody since 04.01.2025 and charge-sheet has been submitted. Petitioner has got no criminal antecedent.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner being the husband of the informant tortured and treated the informant with cruelty on account of demand of dowry.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the clean antecedent of the petitioner along with his period of custody and submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Jamui/concerned court in

Patna High Court CR. MISC. No.24804 of 2025(2) dt.30-04-2025 3/3 connection with Simultalla P.S. Case No. 05 of 2010, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
