JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/201/34/120B of the Indian Penal Code.
Deceased Shailo Devi was married with the petitioner ten years prior to her death. On the date of occurrence i.e., 27.04.2016 the petitioner was in jail, however, on telephone asked the deceased to go to Jhanjharpur to get the treatment of her teeth. Thereafter, co-accused Ranjay Yadav came and took the deceased to Jhanjharpur and dead body of Shailo Devi was found beside the road. There was sign of throttling on the dead body of the deceased.
Patna High Court Cr.Misc. No.49132 of 2016 (2) dt.21-12-2016 2/2 Submission is that co-accused Ranjay Yadav has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.41575 of 2016 on 30.11.2016 and petitioner has been falsely implicated to be harassed.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani/Successor Court, in connection with Phulpras P.S.
