Case No.151 of 2013 registered for the offences punishable under Sections 323, 341, 448, 379, 354(A) and 353 of the Indian Penal Code. Apprehending their arrest, the petitioners filed ABP No.252 of 2014 before the Sessions Judge, Madhubani. The same was rejected on 07.08.2014. Hence, this application for grant of anticipatory bail under Section 438 Cr. P.C. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. A perusal of the F.I.R. discloses that wife of the 1st petitioner by name Sita Devi, who is also an Assistant of the
Patna High Court Cr.Misc. No.37404 of 2014 (2) dt.10-04-2015 2/2 Aanganwari Centre, had submitted a representation against the complainant and for enquiring into the same, several officials came to the Aanganwari Centre, and at that time, the petitioners herein have forcibly entered into the premises. It is stated that the petitioners herein had filed a complaint case against the husband of the complainant herein. Further, most of the sections invoked in the FIR are of bailable offences.
Hence, this application is allowed. In the event of arrest, the petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sri M. K. Srivastav, Judicial Magistrate 1st Class, Madhubani, in connection with Benipatti P.S. Case No.151 of 2013 (G.R. No.2554 of 2013, Tr. No.3671 of 2014), subject to the conditions as laid down under Section 438(2) Cr. P.C. (L. Narasimha Reddy, CJ) Sunil/- U T
