JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioner seeks regular bail in connection with Pipra P.S. Case No. 71 of 2017 (Special Case No. 7565/2017), registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 324, 353, 337, 338, 332, 333 and 504 of the Indian Penal Code and Section 30(a), and 45 of the Bihar Prohibition and Excise Act, 2016 and Section 27 of the Arms Act. Allegation as per F.I.R. is that police on information that some miscreants are engaged in manufacturing illicit liquor raided a hut and seeing the police 15 to 20 males and 10-15 females started fleeing away, out of which, eight ladies were arrested and rest succeeded in fleeing away and from search, huge quantity of Java Mahua was recovered. Thereafter, two hundred to two hundred fifty persons came and attacked the police personnel and also made firing as a result of which, some police personnel
Patna High Court Cr.Misc. No.70200 of 2018(2) dt.06-12-2018 2/2 received injury. However, they caught the petitioner from whose possession 5 litres of liquor has been recovered and from possession of one of the co-accused one country made pistol was also recovered.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the petitioner. Further he has no criminal antecedent and has been in judicial custody since 02.07.2018. So far allegation of assault on the police party is concerned, no specific allegation has been attributed to the petitioner. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Pipra P.S. Case No. 71 of 2017 (Special Case No. 7565/2017).
