2. The petitioner apprehends his arrest in connection with Motihari Muffasil P.S. Case No. 19 of 2024 registered under Sections 420, 465, 467, 468 and 471/34 of the Indian Penal Code.
3. It is alleged that during patrolling, one Prem Kumar was apprehended with a motorcycle in which registration number was found forged and on query, accused Prem Kumar disclosed that he had purchased the said motorcycle from this petitioner one year ago.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the petitioner had purchased a Passion Pro motorcycle bearing Registration No. BR22-M-5642 through auction sale by the District Excise Vehicle Auction Committee, East Champaran,
Patna High Court CR. MISC. No.24917 of 2024(2) dt.24-04-2024 2/2 Motihari on 05.01.2021. The certificate in that regard was also issued by the authority in favour of the petitioner which would be apparent from the FIR itself. The petitioner had sold the said motorcycle to co-accused Prem Kumar one year ago which has been admitted by the said co-accused in the FIR. It is further submitted that the recovered Splendor motorcycle in which the number plate of the Passion Pro motorcycle is allegedly pasted by the co-accused Prem Kumar.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Muffasil P.S. Case No. 19 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
