JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 304(B) of the Indian Penal Code.

Petitioner happens to be husband of the deceased and it is alleged that petitioner and his other family members committed dowry death of the deceased but submission on behalf of the petitioner is that deceased was caught in fire accidentally while she was cooking meal and she was immediately rushed to the hospital by the petitioner and his other family members but unfortunately, she could not be saved. It is further submitted that informant lodged the present case in anger and haste but

Patna High Court Cr.Misc. No.38871 of 2016 (3) dt.15-11-2016 2/2 subsequently, when he realized his fault he entered into compromise.

Regard being had to the facts and circumstances of the case as well as above stated submissions, the prayer for bail of the petitioner in connection with Sessions Trial No. 505 of 2016 arising out of Danapur P.S. Case No. 318 of 2014 pending in the court of Additional Sessions Judge-V, Danapur stands rejected, at least, at this stage.

However, petitioner may renew his prayer for bail if his trial is not concluded within six months from the date of receipt/production of copy of this order to the concerned court. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
