Mr. Sanjay Kumar Tiwary 1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are languishing in custody for the offences punishable under Sections 120B/121/121A of the Indian Penal Code, Sections 3/4/5 of the Explosive Substance Act and Sections 16/17/18/19/20/21 of the U.A.P. Act. The petitioners are in custody since 12.10.2017 having no criminal antecedent.
Allegation is that when the police was combing against the naxal activity, the vehicle of the petitioners was intercepted and checked and police found three bombs inside the vehicle.
Patna High Court CR. MISC. No.71473 of 2018(3) dt.10-04-2019 2/2 Earlier this Court had refused the prayer for bail on 14.03.2018 with direction to the learned trial Judge to conclude the trial within six months. However, report of the learned trial Judge reveals that the case has recently been committed in February, 2019 and thereafter no progress is there. Submission is that the vehicle was of the brother of the petitioners and the petitioners had no knowledge as to what was kept in the vehicle.
Considering the entire facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Chakai P.S. Case No.135 of 2017, with condition that petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
