JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-08-2017 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner seeking quashing of the entire criminal proceeding arising out of Rosera P.S. Case No.217 of 2013 dated 23.09.2013 registered for the offences punishable under Sections 406, 409 and 120B of the Indian Penal Code.

It would be manifest that the first information report was lodged pursuant to the direction made by this Court in MJC No.561 of 2013 arising out of CWJC No.2200 of 2012. It would further be evident from the order dated 11.09.2013 passed in the aforesaid MJC No.561 of 2013 that finding embezzlement of accounts of the Nagar Parisad, this Court had directed the authority of the State to lodge first information report against

Patna High Court Cr.Misc. No.50948 of 2013 (3) dt.18-08-2017 2/2 those involves in the embezzlement.

After some argument, at this stage, learned counsel for the petitioner seeks leave to withdraw the present application in order to agitate the points available to the petitioner at appropriate stage.

Leave is granted.
