Petitioner apprehends his arrest in a case in connection with Complaint Case No. 685C of 2013, under Section 498A of the I.P.C. and 3⁄4 of the D. P. Act.
Petitioner is the husband of the complainant. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife with full dignity and honour. Considering the facts aforesaid, the petitioner is directed to surrender before the learned Court below within four weeks from the date of receipt/production of a copy of the order and the learned court below shall enlarge the petitioner after
Patna High Court Cr.Misc. No.50148 of 2014 (2) dt.10-04-2015 2 / 2 issuing the notice to the complainant, on provisional bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Jamui, in connection with Complaint Case No. 685C of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Thereafter, the learned court below shall make effort for reconciliation the dispute between the husband and the wife. If the dispute is amicably settled between the husband and the wife the provisional bail granted to the petitioner shall be confirmed. If the dispute is not resolved between them, the learned court below shall pass an order on merits on the provisional bail of petitioner. U.K./- (Prabhat Kumar Jha, J) U T
