JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 01-06-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner being the husband apprehends his arrest in relation to Complaint Case No. 1512 of 2014 registered under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

The allegation is that the complainant and the petitioner were married in the year 2011. The petitioner went to Delhi to work thereafter the wife joined but upon return from Delhi, her husband started torturing her and demanded dowry and ultimately thrown out.

Learned counsel for the petitioner drawn attention to

Patna High Court Cr.Misc. No.11070 of 2016 (5) dt.01-06-2016 2/2 this Court to the fact that having returned from Delhi, the petitioner found his wife to be extraordinary intimate to another person. On inquiry, it reveals that in fact the complainant had earlier married with that man and there had been divorce. This fact was not disclosed to the petitioner. She ultimately left the petitioner to live with that man once again. Only to harass the petitioner, this case has been lodged after two years. Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Katihar, in connection with Complaint Case No. 1512 of 2014, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
