JUSTICE SANJAY PRIYA ORAL ORDER 11-12-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant . The petitioner seeks bail in connection with C.A. Case No. 978 of 2014 instituted for the offence under Section(s) 498 A of the Indian Penal Code.

Petitioner is husband of the informant.

Learned counsel for petitioner has submitted that marriage has taken place in the year 1971. The petitioner has two sons and two daughter from the wedlock. He is ready to keep the wife. But, the wife is not living with him. Petitioner is in custody since 29.8.2018 having no criminal antecedent.

No.74109 of 2018(2) dt.11-12-2018 2/2 Learned counsel for the informant has appeared and opposed prayer for bail Keeping in view the period of custody already spent by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna City in connection with C.A. Case No. 978 of 2014, subject to the condition that both the bailers shall be the close relative of the petitioner.

The petitioner shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioner.
