JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-05-2023 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The present petition has been filed seeking two modifications in the order dated 12.03.2021 passed in Cr. Misc. No. 33575 of 2020; the one being the insertion of the alias name of the petitioner and; the other for extension of time for surrendering before the court below.

On the basis of "Aadhar Card" issued in favour of the petitioner, the petitioner requires his name to be read as Abnish Kumar @ Chhoutu Kumar @ Avnish Kumar Choudhary. The aforenoted statement appears to be correct in view of the parentage of the petitioner shown in the "Aadhar

Patna High Court CR. MISC. No.30332 of 2023(2) dt.17-05-2023 2/2 Card". He is son of Arvind Choudhary.

For the reasons stated in the application, both the prayers are allowed.

Let the name of the petitioner be read as Abnish Kumar @ Chhoutu Kumar @ Avnish Kumar Choudhary and time limit for surrendering before the court below to seek advantage of the order dated 12.03.2021 be extended for a further period of four weeks, to be counted from today. Accordingly, the order dated 12.03.2021 stands modified to the extent indicated above.
