JUSTICE SUDHIR SINGH ORAL ORDER 18-01-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Kudhani P.S. case No.25 of 2014 corresponding to S.T. No.283 of 2015/ 392 of 2015 instituted for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge VI, Kaimur at Bhabua. Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with the direction to the trial court to conclude the trial preferably within a period of one year from the date of receipt of the order. In the light of the above direction, the present application has been filed on behalf of the petitioner.

A report was called for from the trial court regarding the stage of the case. It has been reported that out of twelve

Patna High Court Cr.Misc. No.50727 of 2016 (3) dt.18-01-2017 2/2 witnesses four prosecution witnesses have already been examined and the trial is expected to be concluded within a period of six months.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to ensure that the trial is concluded within a period of six months from the date of receipt/production of a copy of this order. The District Magistrate, Kaimur at Bhabua and the Superintendent of Police, Kaimur at Bhabua are also directed to ensure that the remaining witnesses are produced on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Kaimur at Bhabua and the Superintendent of Police, Kaimur at Bhabua.
