The petitioner is apprehending his arrest in connection with Complaint Case No. 1485 of 2017 for the offence registered under Sections 498A and 354 of the Indian Penal Code.
Learned counsel for the petitioner submits that so far as the present petitioner is concerned, he is wiling and ready to keep his wife with all honour and dignity and there shall be no recurrence of any untoward incident so as to cause the informant any mental torture to the informant.
Considering the submissions advanced on behalf of
Patna High Court Cr.Misc. No.74330 of 2018(3) dt.19-12-2018 2/2 the petitioner, let petitioner, above named, in the event of his arrest/surrender before the learned counsel below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Katihar in connection with Complaint Case No. 1485 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is, however, made clear that the petitioner shall take all necessary steps to co-operate with the informant and provide her mental peace and security, as is required by her husband. It is also made clear that if at all any untoward incident happens leading to mental or physical torture, it shall be open for the opposite party no. 2 (informant) to approach this Court for appropriate orders.
