10-04-2015 Heard Mr. Mazhar Alam, learned counsel, who was assisted by Mr. Nafisuzzoha, learned counsel for the petitioner and Sri Anand Kishore Choudhary, learned Addl. Public Prosecutor. The petitioner, who is second wife of husband of the complainant, apprehending her arrest in Complaint Case No.90 of 2012 registered for the offence under Sections 498(A) and 323 of the Indian Penal Code, has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that the husband of the complainant and his other family members have already been extended the privilege of anticipatory bail and this fact has been noticed by the learned Sessions Judge, while considering the anticipatory bail of the petitioner.

No.46080 of 2014 (2) dt.10-04-2015 2/2 Keeping in view the fact that the husband of the complainant and other family members have already been extended the privilege of anticipatory bail, there is no reason to deny the same privilege to the petitioner. Accordingly, let the petitioner, namely, Bibi Hasina @ Hasina, in the event of her arrest or surrender within eight weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhepura in connection with Complaint Case No.90 of 2012 subject to the condition as laid down in Section 438 (2 ) of the Code of Criminal Procedure.
