KUMAR ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Hathauri P.S. Case no. 81 of 2016 for the offences registered under Sections 302 and 201/34 of the Indian Penal Code.
It is alleged that petitioner, who is husband of the deceased Sanju Devi, along with his family members had killed Sanju Devi. He apprehends that his natni Shivani also might have been killed to destroy evidence.
It has been contended on behalf of the petitioner that he has got no criminal antecedent. At the time of alleged occurrence petitioner was out of station for his livelihood. There is no eye witness to the alleged occurrence. It is further submitted that similarly situated co-accused persons have been granted
Patna High Court Cr.Misc. No.22298 of 2017 (2) dt.01-06-2017 2/2 anticipatory bail by a Bench of this Hon'ble Court in Cr. Misc. no. 53091 of 2016.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-X-cum-Addl. Chief Judicial Magistrate, Muzaffarpur, in Hathauri P.S. Case no. 81 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
