1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. It is next submitted that Dinesh (deceased) was in love with Puja. It is next submitted that the family members of Puja were objecting to the said relationship, as such it is alleged that Dinesh was

4. Learned counsel for the petitioners submits that petitioners, being related to Puja, have been falsely implicated in the instant case by the informant. It is further submitted that informant is not an eye witness to the occurrence. It is next submitted that initially the FIR was instituted under Section 302 of the Indian Penal Code read with other sections of IPC, but police after investigation submitted charge sheet under Sections 306 and 34 of the IPC. It is next submitted that the inquest report also records that the death of Dinesh was caused on account of being run down by a train. It is next submitted that even witnesses have stated that since Dinesh was reprimanded and assaulted by the family members of Puja as such, he committed suicide.

The learned counsel for the petitioners, thereafter, draws the attention of the Court to Para-6 of the order impugned to submit that the learned Sessions Judge, West Champaran at Bettiah while rejecting the anticipatory bail application of the petitioners in detail had recorded the materials which transpired during the course of investigation and thereafter submits that the deceased was not killed rather committed suicide, which also stands corroborated by filing of the charge sheet under Sections

It is next submitted that since deceased was in love with Puja, as such, it might be a possibility that family members of Puja might have assaulted him, but then the assault was not reason for the death of the deceased. It is next submitted that petitioners will not abscond rather will co-operate in the trial to prove their innocence.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Srinagar P.S. Case No. 52 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
