Petitioner seeks bail in N.D.P.S. Case No.21 of 2018 instituted for the offence under Section(s) 8 and 20 of the NDPS Act.

Counsel for the petitioner submits that petitioner is aged about 75 years having clean antecedents. He has been arrested on border due to mistaken identity.

In the written report, it is alleged that 6.8 Kg. Ganja has been recovered from possession of the petitioner on IndoNepal Border. Arrest memo has been enclosed with the First

Patna High Court Cr.Misc. No.77414 of 2018(2) dt.15-01-2019 2/2 Information Report, wherein, age of the petitioner has been mentioned as 75 years.

Petitioner is in custody since 23.05.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Bettiah, West Chamapran, in connection with N.D.P.S. Case No.21 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.

Further, (i) the petitioner will remain present on each and every date of trial, (ii) His absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled, and (iii) the petitioner will not intimidate the witnesses in any way and will not hamper the trial.
