The petitioners are facing accusation punishable under section 366 IPC in Supaul P.S. Case No. 480 of 2013 and seek anticipatory bail.

The allegation is that the daughter-in-law of the informant while going to field to attend the call of nature was forcibly kidnapped by the petitioners. On return of the victim her statement under section 164 Cr. P.C. was recorded by the Magistrate on 22.07.2014 wherein she has completely denied her kidnapping. She has stated that on her own she went with petitioner no.1 and solemnized marriage.

Counsel for the petitioner has pointed out the age of the

Patna High Court Cr.Misc. No.43740 of 2014 (2) dt.10-04-2015 2 / 2 girl. In his statement at best it may be a case under section 494 IPC which is a bailable section.

Considering the facts and circumstances of the case, the petitioners abovenamed, in the event of arrest/surrender within four weeks from today shall be released on bail on furnishing bail bonds of Rs. 10,000/- each, with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 480 of 2013 on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, the petitioners shall appear on each date fixed at trial. Failure in appearance on two consecutive dates shall entail cancellation of their bail bonds.
