JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Manager, Madhya Gramin Bank, Aaro, Biharshari is apprehending arrest in a case registered for the offences punishable under sections 420, 467, 468, 406 and 120B of the Indian Penal Code.

The prosecution case is that co-accused Chandrika Singh persuaded the informant to purchase Power Tiller under government subsidy scheme. Subsequently, the petitioner went to the shop of co-accused Sanjai Garai where co-accused Chandrika Singh was also present and both asked to pay Rs.40,000/- at present which was paid by the informant. Thereafter, the accused persons again asked to pay Rs.50,000/- to get the Power Tiller upon which the informant paid Rs.42,000/- and purchased the same. Subsequently, the informant received a notice from the

Patna High Court Cr.Misc. No.45171 of 2015 (2) dt.05-11-2015 2/2 Madhya Bihar Gramin Bank, Biharshari for payment of Rs.27,992/- and, thereby he was cheated by the accused persons. It is submitted by learned counsel for the petitioner that the petitioner has simply been roped in the present case since the informant does not want to repay the loan amount. Admittedly, no payment was made to the petitioner and the informant has filed the present case to evade the recovery notice issued by the Bank authority.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda, Biharshari in connection with Laheri P.S. Case No.84 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
