The petitioner seeks bail in Ander P.S. Case No.133 of 2018 registered under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30, 30(a) of the Bihar Prohibition and Excise Act.

The informant, S.H.O. of Ander police station alleged that on secret information, the police intercepted a four-wheeler truck bearing registration No.UP14-DT-0248 and recovered 3456 liters English wine of different brands. It appears that nobody was arrested on the spot. The petitioner and another accused persons were made accused on the secret information received by the police.

The learned counsel for the petitioner submits that similarly situated other accused persons namely, Saddam Khan

Patna High Court Cr.Misc. No.75707 of 2018(2) dt.18-12-2018 2/2 @ Danish Khan has already been granted bail. Petitioner is in jail since 17.09.2018.

Considering the aforesaid facts and nature of allegation made against the petitioner and the fact that petitioner was neither apprehended on the spot nor anything has been recovered from the possession of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 2nd -cum-Special Judge, Excise, Siwan in connection with Ander P.S. Case No.133 of 2018. (Prabhat Kumar Jha, J) Saurabh/- U T
