The petitioner apprehends his arrest in connection with Brahampur (Nainizore) P.S. Case No.637 of 2020, registered for the offences punishable under Sections 341, 323, 504, 506, 379, 308 and 34 of the Indian Penal Code. The petitioner is said to have assaulted Dadan Yadav on his head by means of iron rod.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is land dispute between the parties and the petitioner has got no criminal antecedent.

By order dated 09.06.2022, case diary and injury report of the injured was called for. Perused the case diary and

Patna High Court CR. MISC. No.32105 of 2021(4) dt.28-06-2022 2/2 the injury report. Only one injury report of Sukul Yadav is annexed with the case diary and from perusal of the injury report of Sukul Yadav, it transpires that the injuries sustained by him are simple in nature. There is no injury report in respect of injured Dadan Yadav in the case diary.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahampur (Nainizore) P.S. Case No.637 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J.) Sanjay/- U T
