2. The petitioners are apprehending their arrest in connection with Nayagaon P.S. Case No. 97 of 2025 for the offence under Sections 126(2), 115(2), 74, 118(1), 109, 303(2), 352 and 3(5) of the BNS lodged on 09.06.2025 by the informant, Rina Devi.
3. As per the prosecution story, the informant alleged that, in the afternoon, while she was sleeping, Suman Rai (petitioner no. 1) entered and tried to molest her. As she screamed, he assaulted her. Later, his brother, Ruman Rai (petitioner no. 2) also joined him and started beating the lady. This led to the FIR.
4. Learned counsel for the petitioners submit that the
Patna High Court CR. MISC. No.22340 of 2026(4) dt.15-07-2026 2/3 injury report shows the injury to be simple in nature, and further, the lady has refused to get the C.T. scan of the brain.
5. Learned APP opposes the prayer submitting that so far as petitioner no. 1, Suman Rai is concerned, allegation of outraging the modesty of the lady is there.
6. Considering the submissions of the parties aforesaid as also taking note of the fact that the petitioner no. 1, Suman Rai has criminal antecedent, no relief can be extended to him.
7. The anticipatory bail application of petitioner no. 1, Suman Rai stands rejected.
8. So far as petitioner no. 2, Ruman Rai @ Ruman Kumar is concerned, he has no criminal history, the role of assault has been assigned to him and the injury has been found to be simple in nature, in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions.
9. Let the petitioner no. 2, Ruman Rai @ Ruman Kumar be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned JMFC, Saran at Chapra in connection with Nayagaon P.S. Case No. 97 of 2025 subject to the following conditions:
(i) one of the bailor should be the family

(ii) the petitioner no. 2, Ruman Rai @ Ruman Kumar shall be appearing before the Police Station as and when required for cooperating in the investigation;
(iii) the petitioner no. 2, Ruman Rai @ Ruman Kumar shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iv) the petitioner no. 2, Ruman Rai @ Ruman Kumar shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds; (v) the petitioner no. 2, Ruman Rai @ Ruman Kumar shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.
