2. The instant application for regular bail has been filed by the petitioner in connection with Falka (Pothia) P.S. Case No. 448 of 2022 instituted for the offence u/s 304B and 34 of the Indian Penal Code.

3.It is a case of dowry death due to non-fulfillment of demand of dowry.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is no prior complaint regarding torture or demand of dowry against the petitioner. There is no eye-witness to the occurrence. The petitioner is in custody since 09.11.2023.

5. Learned APP appearing for the State has vehemently opposed the prayer for bail and submitted that the petitioner is husband of the deceased and he was fully responsible for commission of murder of the deceased. During investigation witnesses have supported the prosecution case and postmortem report shows cause of death due to burn injury.

6. Considering the aforesaid facts and circumstance of the case, I am not inclined to enlarge the petitioner on bail and the prayer is rejected.

7. Learned trial Court is directed to expedite the trial and conclude the same expeditiously.
