JUSTICE SHIVAJI PANDEY ORAL ORDER 09-07-2020 Heard learned counsel for the petitioner and learned counsel for the State, through virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Excise CIS-371/2020 arising out of Buxar (Town) P.S. Case No. 118 of 2020 registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

The police has recovered 42.120 liters of illegal liquor from the Khatal of the petitioner, however, it is urged that nothing has been recovered from the possession of the petitioner and he is in judicial custody since 08.03.2020. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)

Patna High Court CR. MISC. No.21804 of 2020(2) dt.09-07-2020 2/2 with two sureties of the like amount each to the satisfaction of Additional District Judge-II-cum-Special Judge, Excise Act, Buxar in connection with Excise CIS 371 of 2020 arising out of Buxar P.S. Case No. 118 of 2020 with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
