The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 30.01.2016 passed in Cri. Misc. No. 49036 of 2015, on the ground that the petitioner is suffering in custody since 12.08.2015, co-accused Nawab Mian has been allowed bail by another co-ordinate Bench of this court and during investigation it has come that from possession of the petitioner five pockets of charas and from the bag of Nawab Mian four packets charas were recovered and as such the petitioner also deserves sympathetic consideration to which the learned A.P.P. opposes by submitting that from the possession of the petitioner
Patna High Court Cr.Misc. No.44350 of 2016 (2) dt.19-10-2016 2/2 4.50 kg charas and two mobile were recovered. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of bail, again prayer of bail of the petitioner stands rejected.
However, considering the period of detention the trial court is directed to expedite the trial and conclude the same as early as possible, preferably within nine months from the date of receipt/production of a copy of this order.
