JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 07-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Shrinagar P. S. Case No. 29 of 2017 registered under Sections 447, 341, 323, 504, 354, 379 and 506/34 of the Indian Penal Code.

It is contended that petitioner nos. 2 and 3 are sons of petitioner no. 1 Rajendra Ram. It is further contended that the informant is the neighbour of petitioners and due to minor scuffle, an exaggerated story has been narrated to the police

Patna High Court Cr.Misc. No.21860 of 2017 (2) dt.07-07-2017 2/2 pursuant to which the case has been registered inter alia under Sections 354 and 379 of the Indian Penal Code. It is also contended that the petitioners have got roots in the society and they are not likely to flee from justice.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners. Considering the nature of allegation as also the fact that all the petitioners belong to one family and are neighbours of the informant, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Madhepura in Shrinagar P. S. Case No. 29 of 2017, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today. (Ashwani Kumar Singh, J.) Kanchan/- U T
