Despite valid service of notice, nobody appears on behalf of the State.
The petitioner seeks pre-arrest bail in connection with Tariyani P. S. Case No.13 of 2016 registered under Sections 406 and 409 of the Indian Penal Code.
Regard being had to the allegation that the petitioner siphoned of Rs.12,32,750/- taken as advance by him for construction of school building, I am not inclined to grant him pre-arrest bail. Accordingly, his prayer for grant of pre-arrest bail is rejected.
However, in case the petitioner surrenders and
Patna High Court Cr.Misc. No.21875 of 2017 (2) dt.07-07-2017 2/2 seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order. (Ashwani Kumar Singh, J.) Kanchan/- U T
