====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Mansi P.S. Case No. 218 of 2017, instituted for the offence under Section(s) 302, 120(B)/34 of the Indian Penal Code and Section 27 of Arms Act.

In the written report there is specific allegation against co-accused Lambu Yadav and Shambhu Yadav of causing firearm injury to brother of the informant who subsequently died.

Counsel for the petitioner submits that in the post mortem report the Doctor has found one firearm injury on the person of the deceased. Counsel for the petitioner further submits that co-accused Labbu Yadav has already been granted

Patna High Court CR. MISC. No.77383 of 2018(5) dt.08-03-2019 2/2 bail by coordinate Bench of this Court vide order dated 5.9.2018 passed in Cr. Misc. 48652 of 2018.

Petitioner is in custody since 21.7.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Simmi Kajur, learned Judicial Magistrate, 1st Class, Khagaria, in connection with Mansi P.S.
