JUSTICE SANJAY PRIYA ORAL ORDER 6/ 20-12-2017 Explanation has been received from the Officer concerned. Officer concerned has stated that he had sent letter to the Superintendent of Police, Nawada, for sending case diary. This Court is of the view that the duty of the Court below is not only to send letter to the Superintendent of Police when demand of case diary is made from this Court, but to ensure that case diary is received within the time as directed by this Court.
Therefore, this Court is not fully satisfied with the explanation submitted by the Officer concerned. However, since Officer has stated in the explanation that it is his first mistake, explanation of the Officer is accepted with warning to the Officer concerned to remain careful in future.
