The petitioner is apprehending his arrest in connection with Fatuha P.S. Case No. 28 of 2019 for the offences punishable under Section 147, 148, 149, 341, 323, 506, 307, 387 of the IPC 27 of the Arms Act.

The prosecution case got initiated on the basis of written report of Shyamnandan Paswan before the Station House Officer, Fatuha Police Station is to the effect on 13.01.2019 at about 12.00 P.M. petitioner along with several accused persons came on the land of the informant and demolished the newly erected wall. On protest made by the informant and his family members, petitioner and co-accused Bindu Paswan fired upon the informant but did not hit anyone . to any person.

No.20490 of 2019(2) dt.03-04-2019 2/2 It is submitted by the learned counsel for the petitioner that in the back ground of land dispute, accusation is levelled against the petitioner and general and omnibus accusation has been made against the petitioner. No injury has been caused to any one. Statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that petitioner has made firing upon the informant.

Considering the general and omnibus allegation being levelled in the background of land dispute and statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Patna City in connection with Fatuha P.S. Case No. 28 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) sushma/- U T
