Petitioner is in custody since 26.07.2016 in connection with Beldaur P.S. Case No. 115 of 2016 registered under Sections 20 and 22 of the N.D.P.S. Act. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case due to enmity. Nothing has been recovered from the conscious possession of the petitioner. The petitioner, happens to be driver of the alleged vehicle, has no concern with the alleged recovery. The petitioner is rotting in custody for the last five months. Considering the nature of accusation, this Court is not inclined to grant regular bail to the petitioner. Accordingly, this
Patna High Court Cr.Misc. No.44918 of 2016 (3) dt.15-02-2017 prayer for regular bail of this petitioner is rejected. However, the petitioner is at liberty to renew his prayer for regular bail after framing of charge.
