JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-09-2022 At the outset, learned counsel for petitioners seeks permission to withdraw the anticipatory bail application with respect to Jageshwar Kewat petitioner no. 4.

The anticipatory bail application with respect to Jageshwar Kewat petitioner no. 4 is dismissed as withdrawn. Heard learned counsel for the petitioners and learned counsel for the State.

The petitioner nos. 1, 2, 3 and 5 apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

Patna High Court CR. MISC. No.23769 of 2022(2) dt.08-09-2022 2/2 As per the prosecution case, all the accused persons including petitioners having deadly weapons arrived at the place of occurrence and assaulted the informant and his wife by their respective weapons.

It is submitted that injuries sustained by the informant and his wife are simple in nature. There is delay of two days in lodging of the FIR without any explanation. In fact, informant and his family members tried to capture the land of petitioner by force and for that wife of petitioner no. 2 has filed a complaint case bearing Katihar Complaint Case No. 663 of 2021 against the informant and others. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioner nos. 1, 2, 3 and 5 above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Dandkhora P.S. Case No. 101 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
