JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 328, 395, 397 and 412 of the Indian Penal Code. Allegation against petitioner is that he along with other accused persons looted money and other belongings of informant. Earlier prayer for bail of petitioner was rejected vide Annexure-1 to the present application with observation at this stage. Further he was directed to renew his prayer for bail after six months from the date of rejection.

It has been submitted on behalf of petitioner that he is in custody since 13.7.2015. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been made accused due to mistake of fact. Recovery of mobile of the informant is denied by petitioner. He has remained in custody for more than one year. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.42286 of 2016 (2) dt.03-10-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Bettiah, West Champaran, in connection with Bettiah Muffasil (Manuapul) P.S. Case no. 404 of 2015.
