The petitioner in Cr. Misc. No. 44023/2015, namely, Lalit Kumar and the petitioner in Cr. Misc. No. 49473/2015, namely, Shiv Kumar apprehend their arrest in a case under
Patna High Court Cr.Misc. No.44023 of 2015 (3) dt.16-12-2015 2/3 Sections 420, 467, 468, 409, 406, 120(b)/34 of the Indian Penal Code.
It is alleged that the petitioners got issued a wrong land possession certificate in the name of Bharat Sah (the father of the petitioners) in connivance with the Circle Inspector with respect to 4 acres 71 decimals of land. It is submitted that Bharat Sah was having another brother, namely, Bhogal Sah. Both the brothers could have got equal share of land out of 4 acres 71 decimals of land but the father of the petitioners was given land possession certificate with regard to 4 acres 71 decimals of land. It is submitted that the father of the petitioners, Bharat Sah, has already been granted anticipatory bail vide order passed in Cr. Misc. No. 34570/2015. The case of the petitioners stands on the same footing.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S. Case No. 195/2015, subject to the conditions as
Patna High Court Cr.Misc. No.44023 of 2015 (3) dt.16-12-2015 3/3 laid down under Section 438(2) of the Code of Criminal Procedure.
