1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioners no. 1 and 2 are women and the informant alleges that Jesha Ram

No.27185 of 2025(2) dt.06-05-2025 2/3 and Dhanjay Ram in a drunken condition came to purchase momos and when the informant said that he does not have any momos to sell on which an altercation took place and thereafter the accused persons including the petitioners came and assaulted by lathi, Rama, Tangi and sword causing injuries to the informant and Fulendra Kumar.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that informant and the petitioners are related and are having dispute relating to property but then the informant in the FIR has not disclosed that petitioners are related to him. It is next submitted that no doubt in the FIR, it has been alleged that all the accused assaulted the informant and others but then from perusal of Annexure-2 series to the anticipatory bail application i.e. the injury report, it would manifest that the injury suffered by the injured is simple in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners and taking into account the fact that the injury suffered by the injured is simple in nature, let the

No.27185 of 2025(2) dt.06-05-2025 3/3 petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Nasriganj P.S. Case No. 189 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
