JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Chiraiya P.S.Case No. 142 of 2020 for the offences punishable under Sections 379 of the Indian Penal Code and section 7 of th3e E.C.Act. As per F.I.R, the allegation relates to seized of Government rice loaded in Pick-Up vehicle bearing registration No. BR05G-6042 by the informant Rajiv Kumar, who happens to be Block Supply Officer, Chiraiya.
Learned counsel for the petitioner submits that petitioner was driver of the said seized vehicle and the rice in question is not government rice. During investigation no material has come against the petitioner. Petitioner has got

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub -Divisional Judicial Magistrate, Sikarahana at Dhaka, East Champaran in connection with Chiraiya P.S Case No. 142 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
