The petitioner seeks bail in Ahiyapur P.S. Case No. 378 of 2018 (Sessions Trial No. 583 of 2018), instituted for the offence under Section(s) 397 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. The police has arrested the petitioner and recorded his confessional statement. The First Information Report is against unknown.
Petitioner is in custody since 29.5.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.107 of 2019(2) dt.18-01-2019 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge 7th cum Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S.
