JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 22-02-2023 The petitioner by way of this writ petition prays for implementation of an order passed by the Vice Chancellor of the Rajendra Agricultural University, Pusa (Samastipur) dated 29.11.1990, whereby the pay scale of the Technical Supervisor was placed in the scale of Rs.2000-3800/-, who possesses qualification of B.Sc., B.Tec. (Agriculture Engineering) and other similar qualifications.
2. The petitioner claims that he is B.Sc. (Agriculture), therefore, he should be granted the said pay scale. However, it is
Patna High Court CWJC No.15116 of 2015(2) dt.22-02-2023 2/2 admitted at Bar by the learned counsel for the petitioner that the said proposal of granting such pay scale as proposed by the Vice Chancellor was never approved by the State Government.
3. It is settled law that the pay scale to be awarded to the employees of the University has to be approved by the State Government in terms of provisions of Act of the University. Keeping in view thereto, since the order has not been approved, it is not enforceable and therefore, the writ petition for implementation of such order is found to be misconceived. The writ petition is accordingly dismissed.
