JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On the basis of confidential information regarding storage of wine at the Istu House of Raj Kishore Prasad, raid was conducted and during course thereof, Raj Kishore Prasad and Manish Kumar @ Amit Kumar were apprehended. Furthermore, on search, wine in huge quantity as per seizure list were seized from the aforesaid Istu House. On interrogation, it is evident that aforesaid Raj Kishore Prasad had divulged that he used to carry the aforesaid wine through Dhillan Transport having its Branch Office at Riga Road. Accordingly, police raided the office of Dhillan Transport where petitioner, being Manager thereof, was apprehended. Furthermore, on search of the godown, two bottles

No.54288 of 2016 (02) dt.20-12-2016 of Officer Choice each containing of 500 ml, 03 bottles of Black Deluxe Whisky each containing 500 ml, one bottle of Officer Choice containing 180 ml has been seized and for that, it is evident that petitioner happens to be under custody since 23.10.2016, having no criminal antecedent as per Para-3 of the petition.

Accordingly, petitioner, Sanjay Kumar Ojha @ Vinay Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P. S. Case no.674 of 2016.
