====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Bhawanipur P. S. Case No. 218/2023 in a case registered for the offences punishable under Sections 364/367 of the Indian Penal Code and Section 12 of the Children Traffic Act.
3. As per the prosecution case, this petitioner along with other F.I.R. named accused persons are alleged to have kidnapped minor son of the informant.
4. Learned counsel for the petitioner submits that specific accusation of kidnapping is against co-accused Amit Kumar and Chhotan Mandal. Petitioner is only alleged to be working as liner and there is absolutely no allegation of specific overt act against him. He further submits that during
Patna High Court CR. MISC. No.24555 of 2025(3) dt.11-07-2025 2/2 investigation also, victim has not named this petitioner as one of the kidnappers. Petitioner is in custody since 14.02.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Bhawanipur P. S. Case No. 218 of 2023.
