The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 465, 466, 468, 471, 409 and 420 of the Indian Penal Code.
Krishna Kumar owner of Krishna rice mill made allegation in his complaint petition on the basis of which the present FIR is lodged. It is alleged that the petitioner is received only 4000.00 quintals of paddy instead of 4682.92 quintals of paddy. It is stated that the District Manager, Purchase Centre Incharge and the petitioner who was working as an assistant on the contract basis made interpolation in the receipts of 682.92 quintals of paddy. Although, the informant denied to have put signature on
Patna High Court Cr.Misc. No.45941 of 2015 (4) dt.15-12-2015 2/2 the receiving on the aforesaid SIO.
It is submitted that the petitioner has got no manner of concern. It is between the miller and in-charge purchase centre. The complainant received the paddy but knowingly or intentionally denied to have made signature thereon. Learned counsel for the B.S.F.C. further submitted that the miller has fraudulently withdrawn the guarantee amount from the bank after putting forged signature.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, Bihar Sharif in Giriyak (Katari Sarai) P.S. Case No. 10 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
