Petitioner seeks bail in Mojahidpur P.S. Case No.84 of 2017 instituted for the offence under Section(s) 420, 406, 467, 468, 471, 120-B/34 Indian Penal Code and Section 138 of the NI Act.
Counsel for the petitioner submits that petitioner is not named in the First Information Report. It is further submitted that it is mentioned in the written report that agreement was prepared on 27.11.2016 between the informant and Bibi Nausaba (Farzana Parveen) for sale of the land, in question, and other accused, as named, have put their signature
Patna High Court CR. MISC. No.21047 of 2019(4) dt.30-05-2019 2/2 on the alleged agreement. When the sale deed was not executed, the informant put pressure upon the accused to return the money then accused persons gave cheque of Rs.3,50,000/- by committing forgery without mentioning the name and handed over to the informant by mentioning her name, whereas, the petitioner was quite unaware with regard to issuance of cheque in favour of the informant.
Petitioner is in custody since 28.09.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur P.S. Case No.84 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
